Gustav Radbruch

Gustav Radbruch (1878–1949) – niemiecki filozof prawa i polityk, jeden z czołowych przedstawicieli neokantyzmu w prawie.

Dr Maciej Pichlak

Uniwersytet Wrocławski

Abstrakt w języku angielskim: The aim of the paper is to establish a theoretical elaboration of objectivity in law which would conform exiting linguistic practices in the legal field. It starts from a brief characterization of legal practice in this respect which allows for an exposure of semantic complexity of the term ‘objectivity’ in law. The term is said to take two basic meanings: objectivity as a fact and objectivity as a moral ideal. On this ground requirements towards a reliable theory of legal objectivity are defined: such a theory should not only make o room for both distinct meanings of legal objectivity, but also should consider their mutual relations. These requirements stemming from existing linguistic practice serve as criteria for examination of up to date theoretical concepts of objectivity. The paper discusses realistic, conventionalist, and idealistic theories of objectivity in law subsequently and exposes shortcomings of each of these. Eventually, key assumptions of an institutional theory of objectivity are presented which is claimed to offer a plausible understanding of objectivity in law in both its factual and ideal aspects.

Nowe wyzwanie dla pozytywizmu prawniczego

Prof. Herbert L.A. Hart

Uniwersytet Oksfordzki

Abstrakt w języku angielskim: In his lecture, delivered at the Department of the Philosophy of Law of the Autonomous University of Madrid on 29 October 1979, H.L.A. Hart directly responds to Ronald Dworkin’s attack on Legal Positivism, launched in Taking Rights Seriously. In the Sections I–II, Hart explicates his version of Legal Positivism by means of three central positivist theses: the Thesis of the Conceptual Separation of Law and Morals, the Thesis of the Social Sources of Law, and the Thesis of Judicial Discretion. Next, in Section III, he discusses Dworkin’s fundamental objections against the positivist theory of judicial discretion and claims that none of them seem convincing. Finally, in Sections IV–V, Hart analyses a new, herculean theory of adjudication, proposed by Dworkin as a „middle way theory” between the classic theories of Natural Law and Legal Positivism. In his answer to the criticism of the positivist Rule of Recognition, Hart claims that there is no reason why this rule, in certain jurisdictions, would not predict the use of the herculean procedure among the criteria that it provides for the identification of the law. He also states that the use of the herculean method of adjudication is unacceptable for the lawyers and that an impracticable character of this method is easy to demonstrate by referring to the case of the wicked legal systems, in which the principles underlying the law are morally bad. Thus, Hart concludes that instead of a sound vía media between Natural Law and Legal Positivism, the theory of Dworkin seems to offer the confusion of them.

Co może dać nauce prawa polityczność? Przyczynek do przyszłych badań

Dr Michał Paździora, Mgr Michał Stambulski

Uniwersytet Wrocławski

Abstrakt w języku angielskim: The political is a category entirely absent in the Polish theory and philosophy of law. Article presents history of “the political”, category developed by thinkers such as M. Weber, K. Marx, C. Schmitt, Ch. Mouffe and the main assumptions of the practical aims of theory of law present in alternative projects: Poznań-Szczecin methodological school and L. Morawski critical theory. Despite the declared theoretical differences, both projects are characterized by a similar understanding of the theory, which involves the objectivity of knowledge with involvement of universal point of view. Thus, the inclusion of the category of political in both projects, especially in legal education, is ignored.

Koncepcja interpelacji ideologicznej a krytyczny dyskurs o prawie

Mgr Rafał Mańko

Uniwersytet Amsterdamski

Abstrakt w języku angielskim: The present methodological paper aims at answering the question whether the notionof ideological interpellation, put forward by L. Althusser, in the form given to it by S. Žižek, can be operationalised in order to be deployed as a tool for the critical reading of legal texts. The paper gives a positive answer to the question, indicating that the application of the said method may contribute to the opening of legal discourse towards the impact of critical theory. The paper consists of three parts. The first part presents Žižek’s theory of ideology, the second part discusses the notion of ideological interpellation, and the third part is devoted to a preliminary attempt at operationalising the said notion.

W okowach prawniczego sensus communis. O trudnościach uprawiania krytycznie zorientowanej socjologii prawa

Dr Hanna Dębska

Uniwersytet Pedagogiczny w Krakowie

Abstrakt w języku angielskim: The Polish sociology of law is unfamiliar with the critical sociology of law as proposedby P. Bourdieu – one of the most acclaimed contemporary sociologists. Therefore the mainaim of the paper is to indicate the causes of this neglection. The text also points out waysin which Bourdieu’s approach can assist in describing and explaining the social functioningof the legal universe. There are several reasons for the lack of reception of Bourdieu’stheory. The lack of critical debates in the field of law is caused by the assumptions of thetheory. Its main goal is to uncover the mechanisms of domination. Bourdieu’s project givesan opportunity not only to disclose the mechanisms by which the law preserves existingsocial relations, but also to discredit its universality by showing that it favours dominantgroups and agents. As such, Bourdieu’s theory threatens the foundations of the field oflaw. Another reason for this negligence among the Polish sociologists of law is structuralin nature. Firstly, the problem lies in the location of the field of law in the field of power.Secondly, in a specific position that sociology of law holds at faculties of law: academicswho are working on that field are mostly lawyers entangled in legal thinking schemata (legaldoxa), legal sensus communis which is considered as indisputable in the field of law.

Krótka historia brytyjskiej Krytycznej Konferencji Prawniczej albo o odpowiedzialności krytyka

Prof. dr Costas Douzinas

Birkbeck, Uniwersytet Londyński

Abstrakt w języku angielskim: General jurisprudence is a type of thinking about law and the social bond developed by British critical legal scholars. Returning to the classical concerns of (legal) philosophy, it examines the legal aspects of social reproduction both inside and outside state law, treating posited law as a part of wider legality. It brings back to the centre the aesthetic, ethical and material aspects of legality, as well as includes the political economy of law, the legal constructions of subjectivity and the ways in which gender, race or sexuality create forms of identity both disciplining bodies and offering sites of resistance. The British Critical Legal Conference (CLC) is a school of thought committed to a plurality of theoretical approaches to law and to radical politics. The first CLC took place in 1985 and has taken place annually without interruption since. The CLC has introduced a number of themes, approaches and strategies unknown or dismissed by mainstream scholarship, including semiotics, rhetoric, literature, aesthetics and psychoanalysis. A variety of critical schools, such as postmodernism, phenomenology, postcolonialism, critical race, feminism, queer theory, art theory and history, the ethics of otherness, the ontology of plural singularity, the critique of biopolitics and post–politics have been pioneered in the CLC.

O lukach w prawie rzadko spotykanych słów kilka

Dr Maciej Koszowski

Wyższa Szkoła Biznesu w Dąbrowie Górniczej

Abstrakt w języku angielskim: The article addresses the issue of legal gaps (lacunas). Specifically, the author puts forward the general definition of legal gap which uses the concept of ‘automatically applicable’ legal rule as well as presupposes specific understanding of law – namely, that it is consisted solely of the rules of the mentioned type. Next, basing upon that definition, he defines three kinds of lacunas that are commonly distinguished in Polish and international scholarly literature, i.e. extra, intra and contra legem. As it is demonstrated, the merits of proffered definitions are manifold. First of all, they reduce the dependence of the notion of legal gap on value judgment. Secondly, they fairly well fit into the structure of contemporary legal orders. Thirdly, owing to them, the filling of legal gaps is not pointless. And lastly, the other kinds of lacunas one may encounter in academic literature are not at odds with the proffered theory, at least not by definition. At the end of the article, in the light of the main idea of the author’s conception, the Anglo -Saxon notion of the case of first impression is discussed, taking into account different models of (approaches to) the phenomenon of a binding judicial precedent.

Cztery pytania o rządy prawa: Dlaczego? Co? Gdzie? I kogo to obchodzi? Część I

Prof. dr Martin Krygier
