English abstract: In his article, the author asks the question to what extent considerations in the field of axiology regarding the relationship between law and morality can be useful for the development of the legal-philosophical trend known as legal aesthetics, where the subject of interest is, most generally, the relationship between law and beauty. The starting point for reflections is the issue of axiology in the context of the works left by Józef Nowacki, including, first of all, his article “Valuing in the science of law”. Thus, the subject of the article is axiology, but in a sense that covers both ethics and aesthetics. The author distinguishes four types of description used by legal science: normative description, empirical description, theoretical description and – distinguished by the author – axiological description, which can be justified within the framework of axiological subjectivism. It involves evaluating values and either adding or subtracting them, as well as valuing, that is, comparing and weighing values. The author considers what inspiration in this regard can be drawn from axiological inquiries in general, and Nowacki’s works in particular.

Dr Dawid Kostecki

Catholic University in Lublin

English abstract: The development of modern civilization associated with the digital revolution poses entirely new challenges in terms of ethics for public administration. Whereas practical ethical instruments in the form of codes of best practice have already been developed for the profession of a lawyer or a doctor, the internal diversification of the profession of a public official (public authority officials, territorial self-government officials) as well as the transformation of public administration have not been conducive to the development of appropriate ethical standards. The author aims at providing an answer to the following question: on which axiological foundation should the code of a public official be based? On the one hand, historical background seems to be providing a definite answer, on the other, however, current depreciation of the profession of a public official as well as technological progress shed a new light on ethical reflections.

Models used in public administration until now, i.e. the model of ideal bureaucracy, the accountability model, and the new public manager model, have not proven to be effective. Nevertheless, according to the author, the organizational culture within the frame of the good governance model constitutes a unique solution which can prove successful in public administration. At this point, the process of restitution of public officials’ ethos can be a relevant factor. It is so especially due to the fact that public officials’ ethos embodies a development area for educating professional public officials and constitutes a premise for a good functioning of public administration at the same time.

Enumerating the drivers of growth for the public officials’ ethos in connection with a unique idea of the code of best practice based on the triad of integrity, benevolence, and accountability constitutes an axiological suggestion which is noteworthy for the deontology of the profession of a public official.

English abstract: The article presents and analyses a certain theory of values and their role in legal interpretation. The article calls it a ‘componential’ theory of values. According to the theory, values in law create structures based on global assessments: comprehensive axiological judgements that consider all the relevant values and degrees of their realization. The basic theorem of the theory is the theorem on isomorphy between the global assessment and the content of the legal norm. This ‘componential’ theory is the basis of the normative model of legal interpretation. According to this model, the interpreter should reconstruct the global assessment and choose the one possible result of interpretation – the one norm of conduct – which will be the most consistent with this judgement. In order to reconstruct the aforementioned global assessment, the interpreter should consider the legal text, case law and legal literature, legislative materials and interpretative presumption.

The article reconstructs the philosophical presumptions behind the aforementioned theory and model. The article points out that the fundamental value behind the normative model is the intersubjectivity of legal interpretation as an element of the rule of law. The article also indicates that the theory and model described above are based on legal positivism, but with significant connections with legal hermeneutics, Dworkin’s theory of law, and argumentative approaches to law. In addition, the theory seems to presume weak commensurability of values.
