Psychological Competences of Mediators. Selected Aspects of Creative Thinking in the Process of Mediated Conflict Resolution

English abstract: In Poland, recent years have seen a significant increase in interest in alternative methods of resolving conflicts and disputes, including mediation. This is not surprising, since treating conflict work as a creative process during which the parties work out a mutually satisfactory solution makes it an attractive alternative to taking a dispute to court. Assuming that for effective mediation, the mediator’s personal predispositions are as important as the knowledge and skills acquired in courses and training, we analyze selected psychological competencies of mediators, taking into account the specifics of the conflict resolution process they support. The article emphasizes the importance of creative thinking and behavior in the mediation process, taking into account the various stages of the process.

Political Character of the Copyright on the Example of its Inconsistency with the Indigenous People’s Vision of the World

Abstract: The article deals with an inconsistency between the indigenous vision of the world and copyright. The author refers to the category of the political as the proper one to reflect this friction. The work embraces influential intuition of Carl Schmitt on the relationship between politicality and conflict. The author assumes that what can be treated as an expression of political vision (i.e. as something which is not neutral) is political. This approach does not require direct link with the traditionally understood sphere of politics to discern the realm of political.

The conflict between doctor and patient: an attempt to diagnosis, proposals for „treatment”

Abstract: Patients’ rights have become in recent years a particular element of the discussion on health care. They refer to a special relationship. It is often associated with situations in which the medical expert must step into the intimate sphere of life of the sick person. This person also often experience physical or mental suffering. In debates on medicine appeared, however, a new element. It refers to information on conflicts between patients and doctors. These conflicts have a special character. They occur between the person needing help, and an expert who can give it. It is worth to think about: What is the source of that conflict? Does this conflict deepens? Are there systemic forms of assistance in resolving the dispute? Are the mediation procedures may be supported in similar difficult situations? The proposed text is attempt to answers to the above questions.
