Aesthetics of Law

A thematic collection of the “Archive of Philosophy of Law and Social Philosophy”. Texts in the aesthetics of law – the field studying the relations between law and beauty. All articles are available free of charge in open access.

What is the aesthetics of law

The aesthetics of law asks about the relations between law and beauty in three perspectives: law as an object of aesthetic evaluation (the language, form and symbolism of law), law in art – from painting and literature to film – and art as an object of legal regulation. In Polish scholarship the research programme of legal aesthetics was developed by Kamil Zeidler (the monograph Estetyka prawa, 2018), and the field – akin to the law and literature movement – has become a recognisable Polish speciality in world legal philosophy.

Freedom of Speech of an Academic Teacher: Some Conceptual Clarifications and a Landscape of Challenges

English abstract: In presenting this special issue of the “Archiwum Filozofii Prawa i Filozofii Społecznej. Journal of the Polish Section of IVR”, we would like not only to briefly introduce the contents of the individual articles that make up this volume but also to attempt to outline the field of research we are entering. We pursue these tasks in the following order. In the introductory section (1) we present the reasons why it is important and necessary today to address the titular issue. Next, we clarify the notion of the “academic teacher” (2). We then discuss the relationship between “freedom of speech” and “academic freedom”, noting that the relation is far less obvious than it might initially appear (3). Subsequently, we propose a division of the spheres of academic expression into three complementary areas, while emphasizing the preliminary and provisional nature of this distinction (4). In the next section (5) we outline one of the core disputes in the field of academic freedom, namely the opposition between activism and passivism. The final section (6) reviews the content of the articles included in this volume.

Gustav Klimt’s Jurisprudence and the Problem of the Scale of Claims on the Law

Abstrakt w języku polskim: The subject of this article is Gustav Klimt’s Jurisprudenz, a work intended as part of a larger exhibition of paintings depicting specific fields of knowledge. In contrast to the prevailing interpretation of the work in question as an expression of the artist’s personal sense of having been wronged, the authors of this article propose an alternative perspective, suggesting that the image carries a valuable message for legal discourse. As they argue, the image in question makes it possible to identify a potential way of improving the practice of law by reducing claims on it. In terms of the axiological perspective of the considerations, the article is located within the liberal democratic tradition. The article has an interdisciplinary character as Jurisprudence is interpreted from the perspective of art history and legal philosophy.

In Search of the Nomos of Law. Classical Interpretations and New Challenges to the Autonomy of Law

English abstract: The aim of this article is to expose the concepts of the autonomy of law and, more primary, the nomos of law, together with the problems that these concepts imply. Contemporary challenges of legal practice and legal science, such as crises of the rule of law or the juridification of successive spheres of social life, call for a re-positioning and rethinking of the question of the autonomy of law. As the article points out, the discussions around these challenges can be read as disputes about the nomos of law – its possibility, nature and location. In this vein, the article analyses the concept of the nomos of law and then, with reference to Carl Schmitt’s interpretation of this notion, addresses the question of the possibility of the autonomy of law. The article also reconstructs the basic theoretical positions on the nature of the nomos of law and the autonomy of the legal order, with particular reference to the output of the Wrocław school of legal theory and philosophy of law in this area. Against this background, selected current challenges to the autonomy of law are considered.
