Are we facing a crisis of law? Reflections in reference to the so-called claim to correctness problem

Dr Paweł Skuczyński

University of Warsaw

English abstract:
What is usually acknowledged as a topicality indication of Gustav Radbruch’s legal philosophy is the theoretical interest in and practical application of his ideas – known as the Radbruch’s formula – on abominable law, statutory non-law and the refusal to apply it by public authorities, the judiciary in particular. The article main argument is that we can point to other than Radbruch’s formula elements in his philosophy of law which are still applicable and present in the recent discussion on the concept of law itself, its validity and application. What this means is basic to Radbruch’s thought the distinction between the concept of law (Rechtsbegriff), the idea of law (Rechtsidee) and the relationship between the two. The solution accepted by Radbruch in this matter is very broadly applied by the representatives of the nonpositivist concept of law. However, the solution may be ascribed a more general meaning, which manifests itself in the ‘claim to correctness problem’ (Anspruch auf Richtigkeit). Such a claim has to be an element not only of law itself but also of all legal statements including acts of applying the law. The point I endeavour to defend is that out of the three interpretations of the claim to correctness problem, the one which refers not only to the correctness of legal order and law application acts, but also to lawyers’ professional obligations and responsibility is the best justified. This is because such a view most fully addresses the challenges of modern law, which has become increasingly professional in character, but on the other hand more prone to factors typical to fully professionalised walks of life – to critical factors especially. The question of how much the interpretation is compatible with Radbruch’s perspective, is beyond the scope of this analysis. However, some arguments suggesting higher degree of concordance will be presented.

The law as a border in life of a man and states

Dr Dawid Bunikowski

WSB University in Toruń

English abstract:
The law as a border concerns both acts of man and the power and a territory of a state. The law as a border is a social institution more sophisticated than it seems to be in traditional concept of legal positivism and Austin’s point of view. In the state law there are many borders (in criminal law, civil law, administrative law, procedural law relating to terms, freedoms and rights, obligations, going to court, and on the other hand, competences/authorities of public offices etc.). In a narrow sense the law as a border is the state law, which establishes borders of human act and behavior through the sphere of legally allowed, forbidden and ordered acts creating institutionalized legal sanctions for the break of the border and non-respect for legal norms. In a wide sense the law as a border is also mine – „my” law, “internal” law (Petrazycki’s psychological theory of law), making one’s the rules of behavior and relating to the state law (the law as a border in a narrow sense) in many ways. Customary law (also religious law) and international law are very specific branches of the law. I maintain that the law as a border must be supported by other normative systems such as morality, religion etc.

Creating anti-crisis law – axiological dilemmas

Mgr Hanna Dębska

Jagiellonian University

English abstract: The aim of the article is to indicate some of the axiological problems faced by the legislator in the law-making process. They are clearly visible in those legal regulations that are introduced in response to crisis situations.  The presented example – terrorist attack by hijacking a plane – is not only used to demonstrate dilemmas which in this situation must be settled by the legislator preparing relevant legal provisions, but it is also a pretext for enriching the discussion on the axiological aspect of the law. The article focuses on the so-called natural helplessness of law in axiological matters, law inflation and the problem of responsibility. The author concludes that issues indicated in the article cannot be solved in the light of current Constitutional Court’s judgements, which are treated as a reference point of the discussed issues.

Four puzzles about the rule of law: why, what, where? And who cares?

Prof. dr Martin Krygier

UNSW Sydney

English abstract:
Central among the many obscurities that attend the rule of law are those named in the title of the article. The first part contains some preliminary remarks and attempt to answer the first question. This attempt is based on distinguishing two ways of understanding what rule of law is. By the first way rule of law is a theological concept, i.e. to know what it is we have to know its aims and by the second, anatomical one, the most important thing to understand it are rules and institutions that are usually conceived as its part. The author holds a position that only the first way is appropriate and gives his own interpretation of aims of rule of law. This aim is legal reduction of the possibility of arbitrary exercise of power that is connected with four important reductions – of domination, of fear, of indignity, and of confusion.

Story of a footnote. Attempt to reconstruct the discussion of Hans Kelsen and Jerzy Wróblewski

Mgr Monika Zalewska

University of Łódź

English abstract:
Article is an attempt to provide reconstruction of the discourse between Hans Kelsen and Jerzy Wróblewski. The main motive of the article are three footnotes from Hans Kelsen’s General Theory of Norms where he considers such issues as the meaning of the legal norm, and legal interpretation. Reconstruction leads to conclusion that if one treats H. Kelsen’s argumentation as a critique of Jerzy Wróblewski’s theory, this critique doesn’t have sound basis, because it’s essence is not to point contradictions and weakness of the theory, but it is led from the point of view of pure theory of law which itself at some points suffers from the lack of coherency. Thus the other approach of the interpretation of footnotes is offered, to treat them as an some kind of scientific testimony, and as a tool which has on scope to make improvement in pure theory of law. Additionally it has been pointed out, that Hans Kelsen didn’t put the main interest on Marxist issues which occurred in Jerzy Wróblewski’s theory, but on those elements which have it’s importance and are discussed till present day.

The ‘clarification’ theory of legal interpretation as a theory of justification. Psycholinguistic perspective and the positivist idea of legal interpretation

Mgr Marcin Romanowicz

University of Warsaw

English abstract:
Within the framework of legal positivism on the ground of Polish legal theory there was founded, in the scope of the issue of legal interpretation, the ‘clarification’ theory, formulated by J. Wróblewski. Adopting psycholinguistic perspective for the analysis of above mentioned theory allows to take the knowledge about human linguistic cognition into consideration and compare it with the vision of achieving understanding of legal text as understood by J. Wróblewski. Thus conducted “mental experiment” – moving from the level of the legal theory to the level of psycholinguistics – reveals “hidden” properties of J. Wróblewski theory of legal interpretation. First of all, as far as the question about the status of his theory is concerned, it allows to formulate a conclusion that it is neither a descriptive nor a normative theory of legal interpretation. It is possible to accept only as a normative theory of justification of interpretation decisions in the process of law application.

Some Remarks on Contractarian Justification of the Principles of Justice by John Rawls

Dr Paweł Polaczuk

University of Warmia and Mazury in Olsztyn

English abstract:
This paper addresses the issue of whether the justification concerning the principles of justice adopted by Rawls allows for modifying morally significant differentiations found in the basic social structure. The idea of basic social structure as understood by Rawls is explained, and the requirements for justification assumed by Rawls are characterized. Theses requirements are determined by intuitive beliefs concerning justice; whereas such beliefs stipulate certain factors as being morally significant. The analysis of Rawls’s argument indicates that his justification with respect to the principles of justice is based on the criterion of benefit. This leads to privileging these conditions which according to the intuitive beliefs concerning justice should not be privileged. The original position of social groups, however, is not included within the framework of the justification mechanism, and so it requires revaluation for the same reasons as the previously mentioned issue.

Interdisciplinarity and the external integration of jurisprudence in the light of postmodern critique

Mgr Jakub Łakomy

University of Wrocław

English abstract:
The aim of the paper is to reconstruct the critique of the concept of “external integration of jurisprudence”, which has been widely discussed in polish jurisprudence in the past decades. I base my critique on an analysis of the concept put forward in Polish literature by Jerzy Wróblewski and Kazimierz Opałek. I also consider the postmodern critique of the views on interdisciplinarity held by classical jurisprudence.

The first part of the article consists of: a) general remarks on some doubts and ambiguites concerning understanding of “postmodernism” and common misunderstandings of this term and b) some remarks on the relations between law and postmodernism. In the second part of the article, I provide a sketch reconstruction of the basic traits of postmodernism, especially those characteristics, which determine the postmodern attitude towards interdisciplinarity.

In the third, main part of my article I show how the positivist, modern concept of “external integration of jurisprudence” is incompatibile with postmodern views on science, research, knowledge, epistemology and disciplinarity. I provide an in-depth critique of the presumptions and presuppositions underlying this concept. Finally, I ask: “Quo vadis, interdisciplinarity’’? What about the future of interdisciplinary research in the field of law, when the postmodern methodological storm has swept away the old instruments? Here I introduce the concept of “postdisciplinarity”.

Law, economics, human behavior. Discussion about application of behavioral economics to analysis of law

Mgr Magdalena Małecka

Polish Academy of Sciences

English abstract:
Law & economics scholars have claimed, from the very beginning of the movement, that their ambition has been to make studies of law more scientific. The neoclassical approach in economic analysis of law is based on the assumption that rationality of people acting in legal contexts can be characterized in the same ways as rationality of homines economici. However, emergence of behavioral economics and attempts to apply it to analysis of law by some law & economics scholars resulted in critical revising the achievements of neoclassical approach. The so called behavioral law & economics criticizes the neoclassical approach on the basis of experiments, which test hypotheses derived from neoclassical theories. Outcomes of those experiments allow to draw conclusion that in many (legal) contexts people don’t behave in accordance with predictions based on neoclassical models. Behavioral law & economics scholars argue that neoclassical theories are grounded on so highly unrealistic assumptions that in many situations they cannot offer predictions of human behavior. I distinguish three main issues that are discussed: philosophical, methodological and normative ones. I formulate critical comments on the raised arguments and final general remarks concerning possibility of making legal studies more scientific, as well as application of economics to studies on law.

Utility and Wealth-Maximisation: The Philosophical Foundations of the Chicago School of Law and Economics

Dr hab. Beata Polanowska-Sygulska

Jagiellonian University

English abstract:
The article discusses the philosophical rootedness of the economic analysis of law. Utilitarianism is identified as the main source of inspiration for the law and economics movement. A brief account of the most important issues that utilitarianism raises is given. A detailed analysis of the complex relationship between utilitarianism and wealth-maximisation is carried out. The affinities and the differences between the two standpoints are specified. The main disparity, i.e. the status of both maximisation precepts is highlighted. The incoherence of R. Posner’s position including his pragmatic argument for wealth maximisation and his commitment to the thesis about ethical convergence is pointed out.
