Judges’ Virtues and Vices: Outline of a Research Agenda for Legal Theory

Abstract: This article focuses on the issue of applicability of virtue theory to legal theory in civil-law (statutory) jurisdictions and suggests research areas and problems in that respect. The author starts with an assumption that the notion of “virtue” and virtue ethics should be used for the purposes of legal theory starting from references to judicial ethics and normative theory of judicial decision-making. This approach looks especially promising for the purpose of systematizing the chaotic moral language that is being currently used in Poland in reference to judges, their skills, and qualities of their character, which in turn may lead to formulating an explanatory and normative theory of the judicial role that better addresses the observable deficiencies of legal deontology. The author suggests research that could proceed from interpretatively uncovering what are believed to be specific judicial virtues and vices, considering different aspects of the wider Polish and European legal culture of civil law countries (included but not limited to legal and ethical standards, public discourse, legal and other literature, historical and fictional examples, and role models). With respect to judicial ethics, existing virtue theories, including non-eudaimonistic ones, may be examined for the purpose of identifying the model of virtue best suited to the particular nature of the judicial profession. The aretaic (rather than deontological or consequentialist) perspective may enable legal scholarship to take a new path in the debate on the status and qualities of the judiciary, including the problems relating to judicial independence and the selection of candidates for judicial offices.

The Culture of Justification and Public Reason: Comments on the Motion of Members of the Polish Parliament to the Constitutional Tribunal

English abstract: The aim of the paper is to demonstrate how the culture of justification and the public reason can serve as legitimacy device in legal justifications. The idea of the culture of justification, proposed by David Dyzenhaus, makes an interesting contribution to the discussion on how to make headway with the problem of determining the limits of public authority. Applying Ron den Otter’ test of a reasonable sceptic, the author argues that the culture of justification becomes a good political and moral tool for limiting the exercise of public authority, if such a culture is understood and explained in light of the idea of public reason.

David J. Luban’s legal ethics: moral evaluations of acts, subjectivity, responsibility

English abstract:
The purpose of this paper is to present the theory of legal ethics by David J. Luban. The reading of this American philosopher’s project I would like to propose focuses around the three pillars mentioned in the title: the moral evaluation of acts, subjectivity, and moral responsibility. Luban’s theory postulates maintaining the autonomy of an individual performing a lawyer’s role in relation to the institutional structure. Therefore, a lawyer’s activity should be characterised by anxiety and questions ‘what should I do?’ The main axis of Luban’s project is criticism of the standard view supporting the principle that institutional morality is independent of social or individual morality. The principle of neutrality assumes that the morality of a professional role should be limited to the institutional dimension. Such an approach is supposed to prevent (especially in case of an attorney) any individual assessments of the client’s behaviour, or – in a broader sense – performing the professional role at one’s own discretion.

Does every culture deserves a defence? Few queries concerning cultural defence and criminal law in the age of multiculturalism

English abstract:
The aim of the article is to indicate some of the axiological problems faced by the legislator in the law-making process. They are clearly visible in those legal regulations that are introduced in response to crisis situations. The presented example – terrorist attack by hijacking a plane – is not only used to demonstrate dilemmas which in this situation must be settled by the legislator preparing relevant legal provisions, but it is also a pretext for enriching the discussion on the axiological aspect of the law. The article focuses on the so-called natural helplessness of law in axiological matters, law inflation and the problem of responsibility. The author concludes that issues indicated in the article cannot be solved in the light of current Constitutional Court’s judgements, which are treated as a reference point of the discussed issues.

The ius et lex distinction in the contemporary legal science

English abstract: The aim of the paper is to clarify the concepts of ius and lex, as well as to indicate main interpretations of these concepts in the contemporary jurisprudence. For the concepts of ius and lex are not only of historical significance (as used in the legal discourse of the ancient Rome), but they are present in the entire history of the Western legal culture – since ancient times until today. Owing to this rich historical heritage, as well as to the very nature of the discussed concepts, it is impossible to offer classical definitions of ius and/or lex. Therefore, a proper analysis of their meaning will lead to determination of their ‘connotative field’: a map of associations and theories related to these concepts.

In order to realize this task, the paper offers three basic typologies that allow to order mutual relations between existing theoretical standpoints in this field. The first typology concerns a practical function of ius in the legal order. We can distinguish here theories which perceive such a function as mainly negative, positive, or mediating (optimalising). The second typology treats on the sources of binding force of ius. One can indicate positivistic, legalnaturalistic and hermeneutic intepretation of this problem. Finally, the third typology regards mutual relations between ius and lex, which may be described either as hierarchical, or as functionally differentiated. These considerations allow to conclude that the usefulness of such a dualistic way of thinking about the law is ever persisting. Within this perspective the legal order is conceived as containing statutory law (lex) as well as nonwritten binding standards, independent from law–making authorities (ius).

Maciej Zieliński (1940–2020) – Polish legal theorist, creator of the derivational conception of legal interpretation, expressed in the maxim omnia sunt interpretanda. Together with Zygmunt Ziembiński he co-founded the Poznań school of legal theory; his conception remains one of the two main paradigms of Polish interpretive theory.

Institutional Critique as a Research Perspective of Jurisprudence in the Context of Jacques Rancière’s Philosophy

English abstract: The article reflects on the condition of contemporary critique of law in the light of institutional critique derived from the theory of art. This study aims to verify the thesis that institutional critique is a research perspective formed against the background of various trends of critical legal thought. This critique is affirmative and constructive in character. It focuses on the analysis of the performance of reflexive institutions and it also problematizes cognitive tensions that are inherent in legal institutions. The institutions are analysed in the light of the metaphor of aesthetic play. The article presents the theoretical grounding of the relationship between institutional critique and critical legal thinking in the light of the philosophy of law inspired by Jacques Rancière’s thought. Furthermore, selected examples of this critique and directions for its potential application are shown in the context of modelling patterns of dialogic legal culture as understood by the law and humanities movement.
