Abstrakt w języku angielskim: The paper discusses some relationships between the rule of law and the public philosophy. It is unquestionable that nowadays the scientism has become one of the dominant ideologies of industrial and post-industrial societies. Scientists and researchers take an active part in public life, are advisors to governments and corporations, comment in the media important public events. Thus, the problem arises of their moral and legal responsibility for what they say and do in public life. In my opinion, we may distinguish two different models of responsibility, which I call a model of scientist as an ordinary citizen and model of scientist always on duty. To put it another way, we may ask, whether the scientist in public life like an ordinary citizen can act in accordance with his political, economic or religious sympathies and preferences or just like a judge, priest or a physician is always „on duty” and always must follow all the rules of his profession. I defend the view that the adoption of the second model is one of the necessary preconditions of the existence of informed and rational public opinion and thus, the informed and rational rule of law.

System uzasadnienia teorii sprawiedliwości Johna Rawlsa

Abstrakt w języku angielskim: The paper considers a fundamental issue set against the backcloth of John Rawls’s theory of justice, namely the structure of its justification system. The issue is so significant, because justification fulfills a key role in the Rawlsian conception. J. Rawls offers a sophisticated system consisting of different arguments aimed at reaching full justification. In the author’s opinion, there are five elements that relate to each other: 1) original position with the idea of the veil of ignorance, 2) reflective equilibrium, 3) public reason, 4) overlapping consensus, and 5) fundamental constructivist ideas. The five above mentioned arguments seem to be based on four different argumentative strategies: 1) a coherentist strategy – referring to the general and internal coherence of the system; 2) a contractualist strategy – based on the notion of social contract; 3) a pragmatic strategy – referring to the connection with effective social practices; and 4) a constructivist strategy which is founded in the particular view of reasonableness. The justification system evolves from A Theory of Justice to Political Liberalism. However, though the system develops, it is always aimed at the same goal – to gather our considered beliefs and facts about a modern society into a coherent set of judgments which may claim to be valid.

O trzech granicach władzy prawniczej

Abstrakt w języku angielskim: According to the initially assumed concept of limitations of lawyers’ power the most important elements of those limitations are: legal text, legal culture, and ethics. This structure is characterized by the relations where the anterior element defines the framework of the latter, i. e. text affects legal culture and ethics, while legal culture affects ethics. However, exceptions apply where the latter element might lead to the collapse of the framework of the primary factor (for instance, interpretation contra legem based on axiological argumentation). The aforementioned structure of limitations of legal power is complemented by interaction of various other elements, such as social expectations, political entanglement (depending on the extent to which it is not consumed by ethics) and non-judicial expertise.

Prawo spontanicznego porządku – Friedricha A. Hayeka koncepcja regulacji

Abstrakt w języku angielskim: In the article three general questions were posed as a means of presenting explorative issue: (1) Law as regulation of an order; (2) Law as regulation of a liberty; (3) Controversy of social industry in law. In order to realize the issue thus outlined in the first section it has been shown two different and opposites kinds of orders in widely understanding term ‘sociology of law’ as well as Hayekian criticism of Descartes rationality. The structure of exogenous and endogenous orders has been carefully analysed in relation to their ancient equivalents: taxis and nomos. Special attention has been given to make an explanation of Hayekian understanding of legal frameworks connected with the process of organization and division of power. It has been outlined the rule of law in political system of Austrian economist (concept of demarchy) and his principal arguments for legislature and problem of ‘good regulation’. In the second part of thesis it has been shown a widely connection between spontaneous order and both liberty and the process of progression. In this section the strive was to present mostly values and good points in Hayekian conception, but there is also a critical part concerning both unsymmetrical constraint of freedom and symmetrical. In the third part of this thesis it has been shown the historical background of Hayekian research connected with the controversy of social industry in law. Referring to the intellectual dispute between Spencer’s organicism and Durkheim’s paternalistic conception Hayek has divided between law and law-making (legislation) and he has proved that law is only a spontaneous order notwithstanding good legislation means rules of harmonization and maintenance this kind of abstract social structure. Hayek’s concept of law is in accordance with philosophical, sociological, economical and political research of the general and popular nowadays problem with the new paternalism.

Podtrzymywanie porządku i rozwiązywanie konfliktów u prymatów innych niż człowiek

Abstrakt w języku polskim:
W artykule autor prezentuje syntezę wcześniejszych badań prymatologicznych poruszających problem uspołecznienia, porządku społecznego i rozwiązywania konfliktów u prymatów innych niż człowiek. Pierwsza część tekstu zawiera dyskusję na temat zalet i wad uspołecznienia – traktowanego jako jedna z wielu możliwych form wspólnego życia – z perspektywy ewolucyjnej. Nasuwa się pytanie: jakie są dostosowawcze konsekwencje życia społecznego? W następnej części omówiono nieuniknione źródła konfliktów (ograniczających dostosowanie) związane z życiem społecznym. Jest to niezbędny kontekst do analizy istniejących mechanizmów utrzymywania porządku społecznego (włączając w to zapobieganie i rozwiązywanie konfliktów) w różnych społecznościach prymatów innych niż człowiek. Są to bardzo zniuansowane i trudne do dostrzeżenia na pierwszy rzut oka naturalne mechanizmy, które pozwalają czerpać korzyści z uspołecznienia mimo jego ogromnego kosztu ewolucyjnego. Zdaniem autora nauki społeczne mogą wiele skorzystać na refleksyjnym i krytycznym zainteresowaniu szerszymi problemami życia społecznego i porządku społecznego poruszanymi w prymatologii. Artykuł, co oczywiste, nie stanowi wyczerpującego omówienia tych tematów. Jest on raczej próbą zwrócenia uwagi na podstawowe zagadnienia i zainicjowania interdyscyplinarnej dyskusji na ich temat.

Abstrakt w języku polskim:
Spośród wielu niejasności dotyczących rządów prawa centralnymi są te, które zostały wskazane w tytule artykułu. Pierwsza część tekstu zawiera wstępne uwagi oraz próbę odpowiedzi na pierwsze z tytułowych pytań. Próba to jest oparta na rozróżnieniu dwóch sposobów rozumienia, czym są rządy prawa. Zgodnie z pierwszym z nich, rządy prawa są pojęciem celowościowym, tj. by wiedzieć, czym one są, trzeba znać ich cel. Drugi ze sposobów, określony jako anatomiczny, wskazuje, że najważniejszym dla zrozumienia omawianego pojęcia jest poznanie reguł i instytucji, które zazwyczaj postrzega się jako składowe rządów prawa. Autor stoi na stanowisku, że tylko pierwsza droga jest właściwa oraz proponuje własną interpretację celów rządów prawa. Celem tym jest prawne ograniczenie możliwości arbitralnego sprawowania władzy. To natomiast związane jest z czterema ważnymi redukcjami: dominacji, strachu, upokorzenia i niepewności.

Interdyscyplinarność i integracja zewnętrzna nauk prawnych w świetle postmodernistycznej krytyki

Abstrakt w języku polskim:
Celem artykułu jest rekonstrukcja krytyki koncepcji „integracji zewnętrznej nauk prawnych”, która to koncepcja w ostatnich dekadach była szeroko dyskutowana w polskim prawoznawstwie. Opieram moją krytykę na analizie koncepcji przedstawianych w polskiej literaturze przez Jerzego Wróblewskiego i Kazimierza Opałka. Rozważam też postmodernistyczną krytykę poglądów tradycyjnej jurysprudencji dotyczących interdyscyplinarności.

Pierwsza część artykułu składa się z: a) ogólnych uwag dotyczących wątpliwości i niejasności w zakresie rozumienia „postmodernizmu” i typowych nieporozumień związanych z tym terminem i (b) pewnych uwag dotyczących relacji między prawem a postmodernizmem. W drugiej części artykułu przedstawiam zarys rekonstrukcji podstawowych cech postmodernizmu, zwłaszcza tych charakterystyk, które determinują postmodernistyczną postawę wobec interdyscyplinarności.

W trzeciej, głównej części artykułu pokazuję jak pozytywistyczny, współczesny koncept „integracji zewnętrznej nauk prawnych” jest niekompatybilny z postmodernistycznym spojrzeniem na naukę, badania, wiedzę, epistemologię i dyscyplinarość. Przedstawiam pogłębioną krytykę założeń i presupozycji leżących u podstaw tego konceptu. Wreszcie pytam „Quo vadis, interdyscyplinarniości”? Co z przyszłością badań interdyscyplinarnych w polu nauk prawnych, gdzie postmodernistyczna metodologiczna burza zmiotła stare narzędzia badawcze? On the Analytical Importance of the National Interest in Theoretical Exploration of the European Integration Process

This article seeks to elaborate the theoretical discourse on different, competing explanations of the European integration, invoking the notion of the national interest that plays an essential role in the process. Despite increasing integration, the European interest remains quite different from the sum of the national interests of all Member States, and different theories, by presenting explanations of the integration process, raise or diminish its importance. The major premise of the intergovernmental theory is that the integration progress can be analyzed as an intergovernmental regime designed to coordinate the economic and political interdependence negotiated through bargaining. This implies that Member States’ behavior reflects actions taken by their governments based on rational choice, limited only by the domestic social demands and external strategic international environment. According to intergovernmentalism this process, within which states’ preferences are shaped, is in fact the process of national interest formation. In contrast, a second school of thought on integration, affiliated with supranationalism, has a more normative ambition, providing not only a description of the role of the national interest, but also bringing the ideas of its limitation, proposing changes on the mode of European governance aimed at shaping Europe in a more republican manner. Despite the dominant position of the national agents at almost every level of the European governance, for the supranational approaches, due to the multi-level structure of the European Union, controversy between national interest and European common good is rarely invoked. The assumption that one theoretical understanding and the assessment of the level of influence of the national interest as applied to the European integration can have profound legal and political implications, leads us to the conclusion that depicting the five most prominent attempts at capturing it theoretically remains essential for further analysis of the European structure and European legal order. Paradoxically, an unstable economic situation and its overreaching and predominant negative influence on all the Member States, might catalyze a redefinition of Europe and reinvigorate the discourse on both European common good and national interests.

Punishing (Non-)Citizens

If sociologists are to be trusted, reflexivity, focused on itself and devoid of any religious or at least ideological framework, leads to the weakening of control mechanisms. Such changes are accompanied by the polarization of social classes and by the exclusion of the so-called underclass (which certainly includes a vast majority of criminals) from the civil society. In the doctrine of criminal law of “mature modernism”, within the framework of a liberal-democratic state, the civil society, together with the idea of communication, is supposed to constitute a central reference point in the research on criminal liability. Reflexivity brings up new problems. New citizen-oriented criminal law is being shaped, based upon mediation and communication (e.g. restorative justice, Expressive Theory). The civil society does not include the area of politics or political nature of things, where the problem is not the justification of the punishment but the effectiveness of mere spatial isolation. In this sense, it is difficult to talk about the merits of the emancipation of an individual from the limitations imposed by the society. The weakening of any external authority and of political duties owed to the state is replaced by self-control proper to reflexive modernity only in cases where the individuals have adequate intellectual and ethical predispositions. Disappearance of the influence of external rules and values together with the mechanism of exclusion from the civil society results in the weakening of self-control and in selfish care only about one’s own perspective (but also in repressive subordination by the state). Such a state of affairs creates favourable conditions for objectifying criminal liability, abandoning the concept of guilt, and for attempts to provide an ethical justification of penalty – which are concepts taken from the “world of citizens”.
